AtTech 360 Tours - Terms and Conditions of Service

Effective Date: 1st June 2026

This agreement is made between AtTech 360 Tours ("The Provider") and [Insert School Name] ("The Client").

1. Definitions

1.1 "The Service" refers to the photography, production, editing, and hosting of 360-degree virtual tours as agreed upon in the Order Form. 1.2 "The Tour" refers to the compiled, interactive virtual experience created using 3DVista software. 1.3 "Hosting" refers to the deployment of the Tour on The Provider's UK-based servers (managed by Krystal Hosting Ltd) to allow public or private web access.

2. Services Provided & Delivery

2.1 The Provider agrees to capture high-resolution 360-degree imagery, edit the media, and produce an interactive virtual tour in accordance with the specifications of the selected tier (Bronze, Silver, Gold, Platinum, or Bespoke). 2.2 Production timelines will be agreed upon during the Pre-Shoot Consultation. Delivery of the draft Tour will typically occur within 14 business days of the physical shoot. 2.3 The Client is entitled to two (2) rounds of minor revisions (e.g., text changes, hotspot adjustments) before final delivery. Significant structural changes may incur additional fees.

3. Hosting, Maintenance, and Uptime (Silver, Gold, Platinum)

3.1 The Provider utilizes Krystal's "Katapult" cloud infrastructure, ensuring 100% data residency within the United Kingdom to comply with UK GDPR. 3.2 The Provider guarantees an uptime of 99.9%. Scheduled maintenance will be communicated at least 48 hours in advance and performed outside of standard school hours. 3.3 The Dynamic Subscription covers hosting, bandwidth, and standard technical support. Failure to pay the annual subscription fee within 30 days of the invoice date will result in the Tour being suspended and taken offline.

4. Annual Update Service (Platinum Package Only)

4.1 The Platinum subscription includes one (1) working day on-site per 12-month cycle to capture updated panoramas, new interactive student work, or changes to the school layout. 4.2 This update day must be booked at least 30 days in advance by the Client. Unused days within a 12-month cycle do not roll over to subsequent years. 4.3 Priority remote text updates are included, with a guaranteed turnaround time of 48 working hours for minor textual or hotspot adjustments.

5. Intellectual Property

5.1 The Provider retains the full copyright and intellectual property rights to the underlying source code, navigation UI structures, and proprietary 3DVista project files. 5.2 Upon full payment of the Creation Cost, the Client is granted a non-exclusive, perpetual, non-transferable license to display and distribute the final compiled Tour (via iframe or direct link) on their official school platforms. 5.3 The Client retains all rights and ownership over any pre-existing personal data, school branding, logos, and specific imagery/video of students embedded within the Tour.

6. Safeguarding and Consents

6.1 The Client is strictly and solely responsible for obtaining, documenting, and managing informed parental/guardian consent for any staff, students, or visitors whose likeness or voice is captured within the Tour. 6.2 The Client must provide the Provider with a comprehensive list of non-consenting individuals prior to the shoot day, and physically manage the removal of these individuals from the areas being photographed. 6.3 The Provider will employ reasonable measures (e.g., blurring) to mask inadvertently captured faces or sensitive data (e.g., whiteboards) if requested during the review phase, but assumes no liability for the publication of non-consented imagery if the Client signs off on the final draft.

7. Data Protection (UK GDPR)

7.1 Both parties agree to strictly comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. 7.2 The Provider acts as the "Data Processor" and the Client acts as the "Data Controller" in respect to any personal data embedded within the Tour. 7.3 A separate Data Processing Agreement (DPA) will be executed detailing the exact security measures, SFTP protocols, and data retention policies applied by the Provider.

8. Limitation of Liability

8.1 The Provider's total liability under this agreement shall be limited to the total fees paid by the Client in the 12 months preceding the claim. 8.2 The Provider shall not be liable for any indirect, consequential, or reputational damages arising from the use or inability to use the Tour, or from third-party interception of data despite reasonable security measures.

9. Termination

9.1 Either party may terminate the hosting subscription with 30 days written notice prior to the annual renewal date. 9.2 Upon termination, the Provider will permanently delete all associated media files from its servers within 14 days, and provide written confirmation of this deletion. For self-hosted (Bronze) packages, no further action is required by the Provider.
